The Need to Name Power of Attorney or Heath Care Trustees

I read a story in The Journal News which highlights a common occurrence in many personal injury cases, including those which involve a traumatic brain injury. After a debilitating injury, many people find themselves without pre-established provisions such as power of attorney designees or health care trustees. Injured individuals who are incapable of managing their healthcare or finances are then dependent on the courts to make that decision for them. One of my fellow shareholders, Steven Friedman dedicates his practice to assisting people in planning for their future. He is also an accredited estate planner.   1. There is a common misconception that only seniors and the wealthy need estate planning. Individuals who suffer personal injuries, especially injuries to the brain, are at risk if they have not properly arranged their affairs.

    It is critical that we all take the time to designate the individuals to whom we wish to entrust our personal and financial decisions if we become incapactitated. Failing to do so can jeapordize the security of our families.

    My brother was run over by a drunk driver; hit and run car accident that comatized him for weeks; brain injury as well as so many other damages to his body. He is in a facility fighting to regain even below avg. activities.He’s 42 and diagnosed @ a second grade level. He needs someone to look out for his rights and future well being.
