Monetary Recovery for Wrongful Death Claims

Negligence should never take the life of another…but unfortunately it does happen. Some people have been faced with the horrible tragedy of losing a loved one. In my practice I have frequently seen innocent people die because another person was at fault for causing their death. Whether it is a car accident, motorcycle accident and/or work-related accident, the pain of losing a loved one never goes away.

Attention Mediators: Be sure to finalize your settlement agreement in writing

Mediators face yeoman’s work- bringing battling litigants together and assisting them to resolve their dispute without further resort to the judicial process is by no measure an easy task. However, mediators should always be careful to heed the lessons of a recently published Appellate Division case, Willingboro Mall, Ltd. V. 240/242 Franklin Avenue, L.L.C., __ N.J. Super. ___ (App. Div. 2011), and ensure that the mediated settlement is quickly reduced to writing or run the risk of being brought into the fray as a witness when a party seeks to enforce the terms of the unwritten settlement.

Unions Beware: Your Collective Bargaining Power May Be Gone

In March, Wisconsin legislatures voted to reduce the collective bargaining power for union public workers. Basically, the bill prevents or limits union public workers from collectively bargaining for wage increases. In the past, a union was free to bargain for rates that the union deemed fair. The new Wisconsin bill however limits rate increases for union workers, to that of the rate of inflation. This bill also makes public workers pay more towards their pension and doubles their health insurance contributions. For a non-union worker this would be equal to an 8% pay cut. Protests and walk outs by public workers such as teachers have occurred as a result of this new bill. Those in support of the bill maintain that it is to help the budget as it is “the people” that pay for public workers’ union benefits through taxes and other means. Those in opposition see it as unfair to union members and the purpose of unionizing in the first place.
