Graco Recall 2014

If you have infants car seats, please be aware. Graco has recently recalled 1.9 infant car seats because buckles get clogged with food and drinks making it difficult to remove children. Some parents reported having to cut the harness to get their children out. The recall comes after a 5 month dispute between Graco and the National Highway Commission. In that dispute, Graco argued that in an emergency the seat could be removed rather than using the buckle Graco was reluctant to recall the recent the infant seats because earlier this year it recalled 4. 2 toddler seats that also had harness buckle problems. Obviously Graco was unsuccessful as the recall was the largest in U.S. History.

Union Membership Declining

As an attorney who has been born and raised in a union family, I always have concerns over what is going on with unions. While I represent any and all people who have been injured or killed in car accident, industrial accident, medical malpractice, motorcycle accidents, work accidents or by defective products, I take a special interest when it comes to union families.
Recently I came across a study of unions in America. Union membership has been declining for decades. In the last year however the percentage of American Workers in unions basically remained unchanged. Some of the states that remain union strong however are:

Educating Union Leaders on Workman’s Compensation

On Saturday June 7, 2014 I spoke at a quarterly meeting of the Teamsters, Graphic Communications Unions in Philadelphia, PA. Members present were from DC-9/Graphics Communications Union 14-M President, Kurt Freeman and Graphics Communications Union 16-N, President, Joe Inemer. I spoke about difference between third party cases and Workers Compensation claims. I spent time educating the union leaders regarding how to protect their members when injured in a work related accident and the recoveries that could be obtained both under their workers’ compensation claim and the third party claims. It is important for unions to understand the difference between third party claims because each allows a worker to recover differently for their losses. Third party claims are when someone other than the employer causes your accident, even though the accident may occur at work. Workers’ compensation claims are when you are injured at work but the injury is not the fault of anyone else (third party). Joe Inemer commented, “Your presentation was very informative. When it concluded, we continued to discuss what a great presentation it was.”

Google Glass and Distracted Driving

As a member of the organization Enddd.org (End Distracted Driving) I lecture to students, groups and associations to raise awareness to the many ways drivers can be distracted. Despite what people believe even talking on the phones with hands free devices or head sets distracts drivers. Although some states have banned the use of all devices, others still permit hands free and allow cell phone use while driving. Anticipating the change in laws and regulations to stop distracted driving, the internet company Google developed Google Glass. Google Glass is a tiny computer screen in the corner of an eyeglass frame.

Concussions During Football Season

Soon school will be over and football season will be starting. Kids will be asking their parents to play on a local football team. While the initial reaction is to encourage your kids to play sports, when it comes to football there is a reservation, the risk of your child receiving a concussion.

Workers Compensation for the Loss of a Body Part (“Specific Loss”)

The Pennsylvania Workers’ Compensation Act provides that certain injuries are eligible for specific loss awards. A specific loss in Workers’ Compensation is when you lose use of a specific body part. In that case, the Workers’ Compensation Act has predetermined a set amount of weeks that you are permitted to receive payment, based on the body part you lost.

Dram Shop Cases

In a case I recently tried in Bucks County, the jury awarded a verdict to a woman who was repeatedly served alcohol for hours, even after the bar employees observed that she was already intoxicated. One bartender even served her after he was told she was “cut off” from any more alcohol. Thinking she still had the ability to drive, she got in her car and had a one-car accident, seriously injuring only herself.

Different Types of Distracted Driving

As an attorney who handles cases where people are seriously and sometimes fatally injured in accidents, all too often I see accidents caused by distracted driving. Many people do not know that distracted driving is more than texting or being on a phone while driving. It is any activity that takes your attention away from driving. It can include taking your mind off the task of driving, taking your hands off the steering wheel or your taking your eyes away from the road. It does not only occur amongst teens, but by people of all ages.

The Importance of Motorcycle Safety Equipment and Understanding Riding Laws

Stark & Stark motorcycle lawyers love to ride motorcycles on the street, but there are many others out there who prefer recreational riding of ATVs and dirt bikes, or even motocross racing with dirt bikes or quads (a/k/a “4 wheelers”). Anytime you ride there is a known risk of injury or death. We always want to do what we can to minimize that risk. As motorcycle rider, a lawyer who sees catastrophic injuries from motorcycles and a mom who has a son who races motocross, I always stress the importance of safety equipment.
